What is ESIGN?
ESIGN stands for Electronic
Signatures In Global and National commerce.
ESIGN is a federal law which governs the legality
of electronically signed documents. ESIGN
contains several provisions which allow electronically
signed records to enjoy the same legal standing
as paper signatures. ESIGN also provides for
consumer protections that require the consumer
to be presented with a clear and conspicuous
statement providing them full information
about the electronic signing process to which
they must agree.
There are a
few areas where ESIGN does not provide legal support
for electronic signatures. These are:
matters of family law
such as divorce or child support documentation
statutes or regulations
regarding wills codicils or testamentary trusts
court orders or notices
cancellations of utility
services
cancellation or termination
of health insurance or benefits insurance
recall of product,
or material failure of products that risks
health or safety
any documents which
accompany the transport of hazardous materials
Matters such as shown above should
NOT be executed with an electronic signature, as
they are not provided for in ESIGN.
